Terms and Conditions – ANSA Platform and Website

1. Acceptance of Terms
By accessing, browsing, registering for, or using the ANSA website, platform, mobile services, or any associated services (collectively referred to as the Platform), the user agrees to be bound by these Terms and Conditions. If a user does not agree to these terms, the user must not access or use the Platform.

2. Definitions

  • ANSA refers to ANSA Technologies Pty Ltd and its directors, employees, contractors, agents, affiliates and licensors.
  • Platform refers to the ANSA website, software applications, services, databases, AI systems and related digital tools.
  • User refers to any individual or organisation accessing or using the Platform.
  • Content refers to all information, responses, documents, data, text, images, policies, procedures or materials available through the Platform.

3. Nature of the Platform
The Platform provides general information, educational material and AI-assisted guidance relating to transport safety, regulatory frameworks and industry practices. The Platform is intended as a support tool only.

The Platform does not replace official legislation, regulatory advice, workplace procedures, company policies or professional advice.

4. No Legal or Professional Advice
All information provided through the Platform is for general informational and educational purposes only.

The Platform does not provide legal advice, regulatory determinations, compliance certification or professional consulting services.

Users must independently verify any information provided by the Platform and should seek appropriate advice from qualified legal professionals, regulators, compliance specialists or other relevant authorities before relying on any information.

ANSA makes no representation that information provided by the Platform is suitable for any specific operational, legal or compliance purpose.

5. Artificial Intelligence Generated Content
The Platform may use artificial intelligence systems to generate responses and interpret information. AI generated responses may contain inaccuracies, omissions or outdated information.

Users acknowledge that AI systems may produce incorrect or incomplete responses and agree that they will independently verify all information obtained from the Platform.

ANSA does not guarantee the accuracy, completeness or reliability of AI generated responses.

6. User Responsibility
Users are solely responsible for how they interpret and use any information obtained through the Platform.

Users must ensure compliance with all applicable laws, regulations, workplace policies and industry requirements regardless of any information provided by the Platform.

Users must not rely solely on the Platform for safety-critical decisions, regulatory interpretation or legal compliance.

7. Limitation of Liability
To the maximum extent permitted by law, ANSA excludes all liability for any loss, damage, injury, penalty, claim, regulatory action or financial consequence arising directly or indirectly from:

  • use of the Platform
  • reliance on information provided by the Platform
  • AI generated responses
  • errors or omissions in the content
  • misinterpretation of information
  • regulatory changes not yet reflected in the Platform
  • interruption of services

ANSA shall not be liable for any indirect, consequential, incidental, punitive or special damages.

8. Regulatory Compliance Responsibility
Users remain solely responsible for complying with all relevant transport legislation, including but not limited to:

  • Heavy Vehicle National Law
  • Chain of Responsibility obligations
  • fatigue management requirements
  • road rules
  • load restraint
  • workplace safety legislation
  • any other relevant regulatory frameworks

The Platform does not certify compliance and does not provide regulatory approval.

9. Availability of Service
ANSA does not guarantee uninterrupted access to the Platform.

The Platform may be modified, suspended or discontinued at any time without notice.

ANSA may perform maintenance, upgrades or system changes that temporarily interrupt services.

10. User Accounts
Users may be required to create an account to access certain features.

Users must ensure account information is accurate and kept secure.

Users are responsible for all activity conducted under their account credentials.

ANSA reserves the right to suspend or terminate accounts that breach these Terms and Conditions.

11. Acceptable Use
Users must not use the Platform in any way that:

  • violates any law or regulation
  • interferes with system security
  • attempts to reverse engineer the software
  • attempts to extract data or scrape content
  • misuses the AI system
  • uploads unlawful, defamatory or harmful material
  • uses the Platform to provide unlicensed professional advice

12. Uploading Company Documents
Transport operators may upload company policies, procedures or documents to the Platform.

Users uploading documents confirm they have authority to upload and share such documents.

ANSA does not verify the accuracy, legality or regulatory compliance of uploaded documents.

ANSA accepts no responsibility for the content of documents uploaded by users.

13. Intellectual Property
All intellectual property rights relating to the Platform, including software, design, databases, algorithms, AI systems and content, remain the property of ANSA Technologies Pty Ltd unless otherwise stated.

Users may not reproduce, copy, distribute, modify or commercialise Platform content without written permission.

14. Data and Privacy
ANSA may collect and store user data for the purpose of operating and improving the Platform.

Users acknowledge that AI interactions may be analysed to improve system performance.

Personal data will be handled in accordance with applicable privacy legislation and the ANSA Privacy Policy.

15. Third Party Content
The Platform may reference external legislation, guidelines or resources.

ANSA does not control and is not responsible for third party content or external websites.

16. Updates to Legislation
Transport legislation and regulatory requirements change frequently.

ANSA does not guarantee that all legislative updates will immediately appear in the Platform.

Users must verify all regulatory information through official government sources.

17. Indemnity
Users agree to indemnify and hold harmless ANSA Technologies Pty Ltd and its directors, employees, contractors and affiliates from any claim, loss, damage, liability or expense arising from:

  • misuse of the Platform
  • breach of these Terms and Conditions
  • reliance on Platform information without independent verification
  • uploading of unauthorised or unlawful content

18. Suspension or Termination
ANSA reserves the right to suspend or terminate access to the Platform at its sole discretion, including where users breach these Terms and Conditions.

19. Changes to Terms
ANSA may update these Terms and Conditions at any time.

Continued use of the Platform after changes are published constitutes acceptance of the revised terms.

20. Governing Law
These Terms and Conditions are governed by the laws of Australia.

Any disputes arising in connection with the Platform shall be subject to the jurisdiction of Australian courts.

21. Entire Agreement
These Terms and Conditions constitute the entire agreement between ANSA and the user relating to the use of the Platform.

If any provision is found to be invalid or unenforceable, the remaining provisions remain in full force.

22. Artificial Intelligence System Limitations

The Platform utilises artificial intelligence technologies to assist users in locating and interpreting information. Artificial intelligence systems operate using probabilistic models and automated processes which may produce incomplete, inaccurate, outdated, or misleading responses. Users acknowledge that AI generated responses should not be considered authoritative interpretations of legislation or regulatory requirements.Users must independently verify all responses provided by the Platform using official sources or qualified professional advice before relying on the information for operational, legal, safety, or compliance decisions.

23. No Safety-Critical Decision Reliance

The Platform must not be relied upon as the sole source of information when making safety-critical decisions relating to vehicle operation, fatigue management, load restraint, compliance obligations, or other transport-related safety matters.Users acknowledge that operational safety decisions must always be made based on professional judgement, workplace procedures, regulatory guidance, and applicable legislation.

24. Regulatory Interpretation Disclaimer

The Platform may provide simplified explanations of regulatory frameworks for educational purposes. These explanations do not constitute official interpretations of legislation.Only courts, regulators, and authorised government agencies can provide definitive interpretations of legislation.Users must refer to official regulatory publications and guidance when determining legal obligations.

25. Driver Responsibility Statement

Drivers remain solely responsible for complying with all road laws, transport regulations, fatigue rules, vehicle standards, and workplace procedures while operating a vehicle or performing transport-related duties.The availability or use of the Platform does not reduce or transfer any legal responsibilities of drivers, operators, schedulers, consignors, loaders, or other parties within the transport supply chain.

26. Chain of Responsibility Disclaimer

The Platform may reference Chain of Responsibility obligations under transport legislation. However, the Platform does not assess, verify, certify, or guarantee compliance with Chain of Responsibility requirements.Transport companies and individuals must independently ensure their systems and practices comply with applicable legislation.

27. Legislative Update Disclaimer

While reasonable efforts may be made to maintain current information, legislation, regulations, policies, and safety standards may change without notice.ANSA does not guarantee that the Platform will immediately reflect the most current legislative changes. Users must consult official regulatory sources to confirm current requirements.

28. Content Accuracy Disclaimer

All content provided through the Platform is supplied on an “as available” and “as is” basis.ANSA makes no warranties or representations regarding the accuracy, completeness, reliability, suitability, or availability of the information contained within the Platform.Any reliance placed on the Platform is strictly at the user’s own risk.

29. Training and Education Limitation

The Platform may contain educational materials, guidance documents, and explanatory content. These materials are provided solely for general education and awareness purposes.The Platform does not constitute accredited training, formal certification, competency assessment, or regulatory approval.

30.Technical Performance Disclaimer

ANSA does not warrant that the Platform will operate without errors, interruptions, delays, or security vulnerabilities.The Platform may experience downtime due to maintenance, upgrades, technical issues, or external service interruptions.ANSA accepts no liability for any loss or disruption caused by technical issues.

31. Cybersecurity and System Risks

Users acknowledge that internet-based systems may be subject to security risks including unauthorised access, malware, data breaches, or system disruptions.ANSA implements reasonable security measures but cannot guarantee complete protection against cybersecurity threats.Users are responsible for maintaining appropriate cybersecurity protections on their own devices.

32. Data Usage and AI Training

User interactions with the Platform may be analysed in an anonymised form for the purpose of improving system performance, training AI models, and enhancing the accuracy of responses.ANSA may use aggregated or de-identified data for research, product improvement, and service development.

33. Third Party Software and Services

The Platform may incorporate third-party software, hosting services, APIs, or data sources.ANSA is not responsible for the availability, reliability, or accuracy of third-party services.System changes made by third-party providers may affect Platform functionality.

34. User Generated Content

Users who upload documents, policies, procedures, or other materials to the Platform retain responsibility for the legality, accuracy, and ownership of such content.Users must ensure that uploaded content does not infringe intellectual property rights, confidentiality obligations, or legal restrictions.ANSA does not monitor or verify the accuracy of uploaded content.

35. Use While Driving Prohibition

The Platform must not be used while operating a vehicle or performing any activity where the use of electronic devices is restricted by law.Drivers must comply with all laws relating to the use of mobile devices while driving.Users acknowledge that accessing the Platform while operating a vehicle may create safety risks and legal consequences.

36. Commercial Reliance Disclaimer

The Platform is not designed to provide business, financial, regulatory, or operational decision-making advice.Businesses must seek appropriate professional advice before implementing operational changes based on Platform information.

37. No Warranty of Regulatory Compliance

Use of the Platform does not guarantee regulatory compliance or protection from enforcement actions, penalties, or legal claims.Compliance with transport regulations remains the sole responsibility of the user and their organisation.

38. Force Majeure

ANSA shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, cyber attacks, telecommunications failures, government actions, or other unforeseen circumstances.

39. Severability

If any provision of these Terms and Conditions is determined to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall remain in effect.

40. Entire Risk Acknowledgement

By using the Platform, users acknowledge and accept that all information is provided as a support resource only and that the user assumes full responsibility for how information is interpreted and applied.
